Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
VOID WHERE PROHIBITED. CONTEST IS OPEN TO RESIDENTS OF THE UNITED KINGDOM, THE MEMBER STATES OF THE EUROPEAN UNION, THE UNITED STATES AND CANADA ONLY AND IS NOT OPEN TO RESIDENTS OF COUNTRIES WHERE GOODS ARE EMBARGOED BY THE UNITED STATES, UNITED KINGDOM OR EUROPE.
ENTRY IN THIS CONTEST CONSTITUTES ENTRANT’S ACCEPTANCE OF THESE OFFICIAL RULES.
Fangtopia Demo Launch Competition (the “Contest”) is a:
• Prize draw. The Contest is a prize draw, and the winner is selected at random. The Contest is run online on Discord, through the designated competition channel on the official Fangtopia Discord server set out in section 5 (the “Competition Channel”). People who want to take part in this Contest (each an “Entrant”) must play the Fangtopia demo (the “Demo”), create their own kingdom in the Demo, take a screenshot of their finished kingdom and post it in the Competition Channel during the Contest Period. Entrants may receive one (1) additional entry by also posting in the Competition Channel a screenshot showing that they follow an official Fangtopia social media account, so that each Entrant may have a maximum of two (2) entries. Entry to the Contest is open only to persons aged 18 or over who are resident in the United Kingdom, a member state of the European Union, the United States or Canada, subject to section 2. One (1) winner will be selected at random from all eligible entries after the Contest Period ends and will receive one (1) Nintendo Switch 2. The winner is determined by chance, and no skill is involved. Entries are not judged, and the design, quality or creativity of a kingdom does not affect an Entrant’s chances of winning. The Demo is free to download and play, and people who prefer not to post on Discord are not required to enter the Contest. See below for the complete details.
• This Contest is conducted by the PROMOTER. The PROMOTER shall be considered the legal “sponsor” of all prizes, and the PROMOTER shall administer the prizes in accordance with the applicable terms and conditions set out as part of these official rules (“Rules”). Additionally, the PROMOTER shall be solely and entirely responsible for ensuring that the prizes comply with the Rules and all applicable laws in each jurisdiction where the prizes are awarded.
• This Contest is in no way sponsored, endorsed, administered by, or associated with any social media platform, including but not limited to Meta, Discord, TikTok, YouTube, Instagram, or X. Users remain bound by the relevant terms and conditions of any such social media platforms. Please refer to the relevant platform’s terms and conditions page(s) for more information about how they regulate or use data and/or information on behalf of their subscribed users.
• In particular, this Contest is in no way sponsored, endorsed, administered by, affiliated with, or associated with Discord Inc., Valve Corporation (including Steam), or the operator of any social media platform on which an official Fangtopia account is followed (together, the “Platforms”), or with Nintendo Co., Ltd. or any of its affiliates (“Nintendo”), and none of the Platforms or Nintendo are responsible for the Contest in any way. By entering, each Entrant confirms that they are aged 18 or over and releases each of the Platforms and Nintendo from any and all liability in connection with the Contest. Any questions, comments or complaints regarding the Contest must be directed to the PROMOTER and not to any Platform or to Nintendo. Entrants remain bound at all times by the terms of use, community guidelines and other rules of each Platform they use in connection with the Contest (including Discord’s Terms of Service and Community Guidelines, and the rules of the official Fangtopia Discord server), and the PROMOTER may refuse or disqualify an entry where an Entrant fails to comply with them.
1. BINDING AGREEMENT
To enter the Contest, you must agree to these Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. By submitting an entry in the Contest, Entrants agree to these Rules. Entrants may not submit an entry to the Contest and are not eligible to receive any prize described in these Rules unless they agree to these Rules. These Rules form a binding legal agreement between Entrants and the PROMOTER with respect to the Contest.
2. ELIGIBILITY
To be eligible to enter the Contest, you must: (1) be at least 18 years old at the time of entry; (2) be resident in the United Kingdom, a member state of the European Union, the United States or Canada (the “Territory”); (3) not be a resident of any country where the United States, United Kingdom or Europe have embargoed goods; (4) not be a person or entity under any national export controls or sanctions; (5) not be resident in any country where entry to or participation in a prize draw of this kind is prohibited or restricted by law; (6) hold a Discord account in good standing that you control and can access, and be a member of the official Fangtopia Discord server; and (7) where applicable, be eligible to claim any prize you may win. Entrants agree that if they are a winner, they will provide any additional information or consents necessary to confirm eligibility as a winner. Failure to provide additional information or consents will be grounds for disqualification, unless prohibited under applicable law. Employees, interns, contractors, and official office-holders of the PROMOTER, their respective subsidiaries, affiliates, and their respective directors, officers, employees, advertising and promotion agencies, representatives, and agents (“Contest Entities”), and members of the Contest Entities and their immediate families (parents, siblings, children, spouses, and life partners of each, regardless of where they live) and members of the households (whether related or not) of such employees, interns, contractors, officers, and directors are ineligible to participate in this Contest. The PROMOTER reserves the right to verify eligibility and to adjudicate on any dispute at any time.
3. THE PROMOTER
The Contest is promoted by Secret Mode Limited (“the PROMOTER”), whose registered office is at Ground and 2nd Floor, Imperial House, Holly Walk, Leamington Spa, CV32 4JG.
4. CONTEST PERIOD
The Contest begins at 12:00 BST (13:00 CEST; 07:00 EDT) on Thursday 1 October 2026 and ends at 12:00 GMT (13:00 CET; 08:00 EDT) on Monday 26 October 2026 (“Contest Period”). Please note that clocks in the United Kingdom and the European Union go back by one hour on Sunday 25 October 2026, during the Contest Period. ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.
The Contest has one (1) winner. These Rules will be available at https://discord.gg/sCXcXs2tv6 which will be pinned or linked in the Competition Channel and linked from the PROMOTER’s announcements of the Contest on Discord, Steam and social media, throughout the Contest Period.
Entries may only be made in the Competition Channel on Discord, and only during the Contest Period. Any entry posted outside the Contest Period or on any other platform (including on Steam or on any social media platform) is void and not eligible for a prize. The PROMOTER may vary the start or end time of the Contest, where it is reasonably necessary to do so (including because of technical problems with Discord or the Demo, or a change to the release date of Fangtopia), and will announce any such change in the Competition Channel.
5. HOW TO ENTER
During the Contest Period, Entrants may enter the Contest only by the following method, and must complete each of the steps set out below:
Entry online by post in the Competition Channel on the official Fangtopia Discord server, available at: https://discord.gg/sCXcXs2tv6. There is no postal, email, Steam or social media route of entry to this Contest, and no entry submitted by any other means will be valid.
• download and play the Demo, which is available free of charge on Steam at Fangtopia Demo on Steam and create their own kingdom in the Demo;
• take a screenshot of their finished kingdom (the “Kingdom Screenshot”); and
• during the Contest Period, post the Kingdom Screenshot in the Competition Channel from the Entrant’s own Discord account, so that the PROMOTER can find the entry.
Additional entry. An Entrant who has posted a valid Kingdom Screenshot may receive one (1) additional entry by also posting in the Competition Channel during the Contest Period, from the same Discord account, a screenshot showing that the Entrant’s own social media account follows an official Fangtopia account, being @FangtopiaGame on X or @FantopiaGame on Instagram (the “Follow Screenshot”). The Follow Screenshot must clearly show both the Entrant’s own account and that it follows the official Fangtopia account. A Follow Screenshot posted by an Entrant who has not posted a valid Kingdom Screenshot will not count as an entry. Following a Fangtopia account is optional and is not required to enter the Contest.
Entering the Contest is voluntary. The Demo is free of charge, and Entrants are not required to purchase Fangtopia or any other product in order to enter. Entrants must keep their posts in the Competition Channel, and must not delete them, until the winner has been announced, because the PROMOTER can only find entries that remain posted. A post that is made outside the Competition Channel, or that is deleted before the winner is selected, will not be eligible for a prize. Entrants must remain members of the official Fangtopia Discord server and must be able to receive direct messages on the Discord account used to enter, until the winner has been announced, because a direct message to that account is the only means by which the PROMOTER will contact the winner.
The Discord account used must be an account that the Entrant controls and is able to access. The Kingdom Screenshot must be an original screenshot of a kingdom created by the Entrant in the Demo, and must not have been digitally altered, taken from another person’s game or post, or created or edited using artificial intelligence. The Follow Screenshot must be a genuine, unaltered screenshot of the Entrant’s own social media account. Entrants must not include the personal information of any other person in their screenshots. Where an Entrant’s Discord account does not accept direct messages from the PROMOTER, the PROMOTER will be unable to notify them, and their entry may be treated as void in accordance with section 6. It is the Entrant’s responsibility to monitor their Discord account, including message requests, during and after the Contest Period. The PROMOTER will only contact the winner from its official Discord account(s), @SecretModeJo, and will never ask Entrants for payment, passwords or bank or card details. Personal data given on entry is handled in accordance with section 11 below.
Each valid Kingdom Screenshot posted in accordance with the above is classified as one (1) entry, and each valid Follow Screenshot is classified as one (1) additional entry. Each Entrant may have a maximum of two (2) entries in total, being one (1) entry for a Kingdom Screenshot and one (1) additional entry for a Follow Screenshot, regardless of the number of screenshots or posts made, or the number of kingdoms created. Entries submitted using multiple or automated accounts will be disqualified. Where an Entrant posts more than one (1) Kingdom Screenshot or more than one (1) Follow Screenshot, only their first valid Kingdom Screenshot and first valid Follow Screenshot will be counted, and posting the same or similar content repeatedly will not increase an Entrant’s chances of winning. One (1) prize is available across the Contest as a whole.
In addition to any other requirements set forth in these Rules, in order to be deemed eligible for participation, where applicable, each entry and/or the Entrant submitting it must meet the following conditions and restrictions, and for these purposes references to an “entry” include the Kingdom Screenshot, the Follow Screenshot, any name given to the kingdom, the text of the post and the Discord username of the Entrant and any other content posted by the Entrant in connection with their entry:
(a) The entry must not disparage any person or entity, defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights or constitute or suggest copyright infringement.
(b) The entry must not contain any content that is sexually explicit, offensive, illegal, pornographic, or obscene or that features, promotes, or suggests the use or abuse of drugs, alcohol, tobacco, firearms, or other harmful substances or otherwise is in bad taste or is otherwise objectionable to the PROMOTER, determined by the PROMOTER in its sole discretion.
(c) The entry or Entrant must not depict material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
(d) The entry must not depict material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the entry is created.
The PROMOTER in its sole discretion shall determine if any entry or part thereof is inappropriate for any reason for public release or publication and shall have the right to disqualify any entry that it deems to not meet the criteria above, or due to technical, legal (including intellectual property rights infringement), clearance or other problems, or otherwise in breach of the above Rules, as determined by the PROMOTER in its sole discretion.
No purchase or payment of any kind is necessary to enter or win this Contest. No purchase made by an Entrant (e.g. one of the PROMOTER’s products) will increase an Entrant’s chances of winning. The Contest is a prize draw, and the winner is determined by chance. The chances of winning depend on the number of valid entries received during the Contest Period, and an Entrant with two (2) valid entries will have two (2) chances of being selected in the draw.
6. WINNER(S)
There will be one (1) winner. Within five (5) business days after the end of the Contest Period, the winner will be selected at random from all valid entries received during the Contest Period, using a verifiably random computer process or under the supervision of a person independent of the PROMOTER. The winner is only entitled to one (1) win, and one (1) prize.
An entry will only be treated as valid where it was posted in the Competition Channel during the Contest Period, by an eligible Entrant in accordance with section 5, and without the use of any bots, automated software, fake or duplicate accounts, or other means of artificially generating entries. The PROMOTER may in its sole discretion void any entry that it reasonably believes was not made in accordance with these Rules, and the PROMOTER’s decision as to the validity of an entry is final.
If an entry selected in the draw is not verified as valid, an alternate potential winner will be selected at random, in the same way, from the remaining valid entries.
Information pertaining to the method by which entries are verified and the winner selected can be provided for up to thirty (30) days following the conclusion of the Contest Period on written request to the PROMOTER at the registered office address listed above.
On or within five (5) business days of the close of the Contest Period, the winner will be notified by the PROMOTER’s community team by direct message, sent to the Discord account used by that Entrant to post their entry, and the PROMOTER may announce in the Competition Channel and on its official social media accounts that the winner has been selected.
If a potential winner does not respond to the notification attempt within forty-eight (48) hours from the notification attempt, then such potential winner will be disqualified, and another Entrant will be selected at random from the remaining valid entries as an alternate potential winner. Each potential winner may be required to sign and return a “Declaration of Eligibility and Liability and Publicity Release” and provide any additional information, such as that referenced in section 8 below, that may be required by the PROMOTER.
Potential winners must return all such required information within five (5) days following attempted notification or such potential winner will be deemed to have forfeited the prize and another Entrant may be selected at random from the remaining valid entries as an alternate potential winner.
In order to receive the prize, the winner will need to give the PROMOTER their full name, a postal delivery address in the Territory, an email address and a contact telephone number for the courier. The PROMOTER will use those details only for the purpose of arranging delivery of the prize, in accordance with section 11 below.
The PROMOTER reserves the right to modify the notification procedures in connection with the selection of any alternate potential winners, if any. In the event of a dispute about the identity of an Entrant, each entry will be deemed to have been made by the authorised holder of the Discord account used to post the entry. With respect to the winning entry, the winner may be required to provide proof that they are the authorised holder of the Discord account associated with the winning entry (and, where the winning entry is a Follow Screenshot, of the social media account shown in it), photographic proof of their identity and age, proof of residence in the Territory, and evidence that they are otherwise eligible to enter the Contest.
All notification requirements, as well as other requirements within these Rules, will be strictly enforced. Determinations of the PROMOTER are final and binding.
7. PRIZE(S)
One (1) prize is available in total: one (1) Nintendo Switch 2 console, controller and case bundle. The prize will be sent to the winner’s postal delivery address in the Territory at the PROMOTER’s cost (subject to section 8), within thirty (30) days of the PROMOTER receiving the winner’s delivery details. No cash alternative will be offered. The prize is supplied subject to the manufacturer’s terms and warranty. Use of certain features of the prize may require a Nintendo Account, an internet connection and acceptance of Nintendo’s terms, and no games, subscriptions, online services or accessories (other than those supplied in the box by the manufacturer) are included in the prize.
The Approximate Retail Value of the prize is £500. The actual market value may vary based on item brands and be subject to market fluctuations; any difference between actual market value and Approximate Retail Value will not be awarded.
No transfer, substitution, or cash equivalent for prizes is allowed, except at the PROMOTER’s sole discretion. The PROMOTER reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. The Contest Entities have not made and are not making, and the Contest Entities are not responsible in any manner for, any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize, or regarding the use, value or enjoyment of the prize, including, without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer’s warranty that may apply to the prize or any components thereto.
In the event that no valid entries are received during the Contest Period, no prize will be awarded.
The PROMOTER is not responsible for inaccurate prize details supplied to any Entrant by any third party connected with this Contest. The PROMOTER will not replace any lost or stolen prizes once in the winner’s possession.
8. TAXES
RECEIPT OF PRIZES TO POTENTIAL WINNERS/WINNERS IS SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO THE PROMOTER ALL DOCUMENTATION REQUESTED BY THE PROMOTER TO PERMIT IT TO COMPLY WITH ALL APPLICABLE TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES THE PROMOTER IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES, INCLUDING ANY IMPORT DUTIES, CUSTOMS CHARGES AND ANY VAT, GST OR SALES TAXES PAYABLE ON THE IMPORTATION OR DELIVERY OF A PRIZE, ARE THE SOLE RESPONSIBILITY OF THE WINNERS, REGARDLESS OF WHETHER TAXES HAVE BEEN SO WITHHELD.
To receive a prize, potential winners may be required to submit the tax documentation requested by the PROMOTER or otherwise required by applicable law, to the PROMOTER or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winner’s country of residence. The potential winners are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and the PROMOTER may, in its sole discretion, select an alternative potential winner in accordance with these Rules.
9. GENERAL CONDITIONS
All local laws and regulations apply. The PROMOTER reserves the right to disqualify any Entrant from the Contest if, in the PROMOTER’s sole discretion, it believes that the Entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Entrants, viewers, the PROMOTER or the Contest Entities.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, the other provisions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The PROMOTER’s failure to (or decision not to) enforce any provision in these Rules shall not constitute a waiver of that or any other provision.
10. INTELLECTUAL PROPERTY RIGHTS
Entering the Contest does not create or confer any licence, right or ownership interest under any copyright, trademark or other intellectual property laws in or to any intellectual property owned, licensed to and/or controlled by the PROMOTER, including the Demo, Fangtopia and any in-game content shown in a Kingdom Screenshot. To the extent that an Entrant holds any rights in their entry, the Entrant retains those rights but, by entering, grants the PROMOTER a non-exclusive, royalty-free, worldwide licence to reshare, display and reproduce their Kingdom Screenshot on the PROMOTER’s and Fangtopia’s social media channels, Discord servers and Steam pages in connection with the Contest and Fangtopia, crediting the Entrant’s username where reasonably practicable. The PROMOTER will not publicly reshare any Follow Screenshot.
11. PRIVACY
Each Entrant acknowledges and agrees that the PROMOTER may collect, store, share and otherwise use any personally identifiable information provided to the PROMOTER throughout the Contest, being the Discord username, Kingdom Screenshot, Follow Screenshot (including the social media username shown in it) and posts made by the Entrant on entry and, in the case of the winner only, the full name, postal delivery address, email address and contact telephone number needed to fulfil the prize. The PROMOTER will use this information in accordance with its Privacy Policy located at https://wearesecretmode.com/privacy-policy, for the purposes of administering the Contest, selecting and verifying the winner, and arranging delivery of the prize. The PROMOTER’s legal basis for that processing is the performance of the agreement between the Entrant and the PROMOTER constituted by these Rules. The PROMOTER will not use the details given on entry for marketing purposes and will not add Entrants to any marketing list. The Discord account used on entry will be used only to contact the winner and to obtain the details needed to send the prize, and those delivery details will be shared with the courier for the purpose of delivering the prize only. The PROMOTER may need to share the Contest winner’s personally identifiable information with suppliers for the purpose of ordering and shipping the prize directly to the winner.
Entering the Contest is voluntary, as set out in section 5. The PROMOTER collects only the Discord username, screenshots and posts needed to run the Contest and to select and contact the winner and collects delivery details only from the winner and only for the purpose of delivering the prize. Entrants acknowledge that their entries will be visible to other members of the official Fangtopia Discord server, and that Discord Inc. processes information on its platform under its own privacy policy and not on behalf of the PROMOTER.
The PROMOTER will retain the personal data given on entry by Entrants who do not win for no longer than thirty (30) days after the end of the Contest Period, after which those details will be securely deleted. The personal data of the winner will be retained for as long as is necessary to deliver the prize and to respond to requests under section 19 below, and thereafter only for so long as the PROMOTER is required to retain it to comply with its legal, accounting and tax obligations.
Where the PROMOTER uses a third party to collect or verify entries, to conduct the random draw or to fulfil and ship the prize, that third party acts as the PROMOTER’s processor under a written contract that requires it to process the personal data only on the PROMOTER’s instructions and to keep it secure.
Entrants have the right to request access to, rectification of, or erasure of their personal data held by the PROMOTER in connection with the Contest, to request the restriction of or to object to its processing, and to request that it be provided to them or to a third party in a portable form. Requests may be made by writing to the PROMOTER at the registered office address given above, marked for the attention of the Data Protection Lead, or by using the contact details in the Privacy Policy. Because the PROMOTER cannot administer the Contest or award a prize without an Entrant’s Discord username and entry, a request for erasure made before the end of the Contest Period will be treated as a withdrawal from the Contest. Entrants also have the right to lodge a complaint with the Information Commissioner’s Office in the United Kingdom or with the supervisory authority in the country in which they live or work.
12. PUBLICITY
By accepting a prize, notwithstanding anything to the contrary in these Rules, the winner agrees to the PROMOTER’s and its agencies’ use of their name and/or likeness and the contents of their entry (where applicable) for advertising and promotional purposes of the Contest without additional compensation, unless prohibited by law. Entrants may be asked to complete a publicity release.
13. WARRANTY AND INDEMNITY
To the maximum extent permitted by law, each Entrant:
(a) represents and warrants that they are aged 18 or over and resident in the Territory at the time of entry and at the time any prize is claimed, and agrees to provide photographic proof of identity and age, and proof of residence, if the PROMOTER requests it;
(b) indemnifies and agrees to keep indemnified the PROMOTER at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any representation or warranty set forth herein; and
(c) agrees to defend, indemnify and hold harmless the PROMOTER and the Contest Entities from and against any and all claims, actions, suits or proceedings, as well as any and all injuries, losses, liabilities, damages of any kind to persons or property, including death, costs and expenses (including reasonable legal fees) arising out of or accruing in whole or in part, directly or indirectly from the Entrant’s participation in the Contest or any Contest-related activity or (i) any misrepresentation made by the Entrant in connection with the Contest; (ii) any non-compliance by the Entrant with these Rules; (iii) claims brought by persons or entities other than the parties to these Rules arising from or related to the Entrant’s involvement with the Contest; (iv) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; (v) any malfunction or other problem with the Contest site(s); (vi) any error in the collection, processing or retention of entry information; or (vii) any typographical or other error in the printing, offering or announcement of any prize or winners.
14. ELIMINATION
Any false or incorrect information provided within the context of the Contest by any Entrant concerning identity, age, residence, mailing address, telephone number, email address, ownership of right, or non-compliance with these Rules, or the like, may result in the immediate elimination of the Entrant from the Contest.
15. INTERNET AND OTHER TECHNICAL ISSUES
The PROMOTER and the Contest Entities are not responsible for any malfunction or for any late, lost, damaged, misdirected, incomplete, undeliverable or destroyed entries due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Contest site(s), or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an Entrant’s ability to participate.
16. RIGHT TO CANCEL, MODIFY OR DISQUALIFY
If for any reason the Contest is not capable of running as the PROMOTER intended, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, the PROMOTER reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Contest and if terminated, the PROMOTER may elect to determine the potential winner for the Contest from among the valid entries received before that action was taken. The PROMOTER further reserves the right to disqualify any Entrant who violates these Rules or tampers with the submission process or any other part of the Contest or Contest site(s). Any attempt by an Entrant to deliberately damage any website, including the Contest site(s), or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, the PROMOTER reserves the right to seek any and all remedies available from any such Entrant to the fullest extent of the applicable law.
The PROMOTER reserves the right to cancel or amend the Contest and these Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the PROMOTER’s control or where it becomes necessary to do so. Any changes to the Contest will be notified to Entrants as soon as possible by the PROMOTER.
17. LIMITATION OF LIABILITY
The PROMOTER and the Contest Entities are not responsible for: (a) lost, late, damaged, destroyed, delayed, stolen, misdirected, incomplete, illegible or garbled entries, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware, or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorised intervention in any part of the entry process or the Contest; or (e) printing, typographical, electronic, or human errors which may occur in the offer or administration of the Contest or the processing of entries. Entrants agree that any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Contest (but not the development of the entry) but in no event legal representatives’ fees; and Entrants waive all rights to claim any punitive, incidental, consequential, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
18. JURISDICTION AND GOVERNING LAW
To the extent permitted by law, the laws of England and Wales apply to these Rules, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. THESE RULES APPLY SOLELY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
19. LIST OF WINNERS
You may request the name of the winner, comprising the first name and the first initial of the surname of the winner only, for up to thirty (30) days following the conclusion of the Contest Period on written request to the PROMOTER’s registered office marked for the attention of the Marketing Department.
